Terms of Service

These Terms of Service (“Terms”) govern all services provided by 77-Technologies (Pvt) Ltd, SECP Reg. No. 354090989, Model Town, Lahore, Pakistan (“77-Technologies”, “we”, “us”). By requesting a proposal, paying an invoice, or using our services, you (“the Client”) agree to these Terms. Where a signed written agreement exists between us and the Client, that agreement prevails over these Terms to the extent of any conflict.
1. Proposals and scope
- Every project begins with a written proposal listing the features, deliverables, timeline and fixed price. Only what is written in the proposal is included in the project.
- Anything not written in the proposal — additional features, extra pages, new integrations, additional platforms — is a change request, quoted and billed separately. Verbal discussions, assumptions or expectations do not form part of the scope.
- Proposals are valid for 14 days from the date of issue unless stated otherwise.
2. Payments
- Projects start only after receipt of the advance payment stated in the proposal. The advance covers scoping, design and mobilization and is non-refundable once work has begun.
- Remaining payments are tied to milestones defined in the proposal. Each milestone invoice is payable within 7 days. Work pauses on overdue invoices, and the timeline extends by the length of the delay.
- If an invoice remains unpaid for 30 days, we may terminate the project. Amounts already paid are not refundable, and clause 5 (intellectual property) applies.
- Bank charges, taxes and third-party fees (domains, hosting, store accounts, gateways) are the Client’s responsibility unless the proposal states otherwise.
3. Client responsibilities
- The Client must provide content, credentials, approvals and feedback within the times stated in the proposal (or within 7 days where no time is stated). Delays on the Client’s side extend the timeline day-for-day and, after 30 days of inactivity caused by the Client, we may treat the project as suspended and re-quote the remaining work before resuming.
- The Client warrants that all content and materials supplied to us are legally owned or licensed by the Client.
4. Revisions
- Each design or milestone includes up to two rounds of revisions within the approved scope. Further revisions, or revisions requested after a milestone has been approved, are billed as change requests.
- Approval of a milestone (in writing, including WhatsApp or email) is final for that milestone.
5. Intellectual property
- Ownership of the project’s source code and deliverables transfers to the Client only upon receipt of full and final payment. Until then, all work remains the property of 77-Technologies.
- We retain ownership of our pre-existing tools, generic components, and know-how, which are licensed to the Client for use within the delivered project.
- Open-source components remain under their own licenses. Third-party services (hosting, payment gateways, app stores) remain under their own terms.
- We may reference and display the delivered project in our portfolio and marketing unless the Client requests otherwise in writing or a non-disclosure agreement is in place.
6. Delivery, support and warranty
- On full payment we hand over the source code, accounts and documentation stated in the proposal.
- The free support period stated in the proposal covers defects — things that were delivered and do not work as specified. It does not cover new features, content changes, third-party service failures, or issues caused by changes made by anyone other than us.
- After the free support period, support is available under a monthly care plan or billed per request.
7. Third-party services
We integrate and configure third-party services (hosting providers, payment gateways such as JazzCash and Easypaisa, app stores, SMS/WhatsApp providers, advertising platforms) on the Client’s behalf, but we do not control them. We are not liable for their availability, pricing changes, policy decisions, account suspensions, or data handling. Approval of accounts (e.g. app store review, gateway onboarding) is at the third party’s discretion and is not guaranteed by us.
8. Digital marketing services
- Marketing plans are billed monthly in advance. Advertising budgets (Google, Meta, etc.) are separate from our fee and are paid by the Client directly to the platform.
- We commit to professional execution — not to specific rankings, follower counts, lead numbers or revenue. Marketing outcomes depend on factors outside any agency’s control, and no such outcome is guaranteed.
- Plans may be cancelled with notice before the next billing month. The current month is not refunded.
9. Limitation of liability
- Our total liability for any claim arising from a project is limited to the total fees actually paid by the Client for that project.
- We are not liable for indirect or consequential losses, including lost profits, lost data, lost business, or reputational damage.
- The Client is responsible for maintaining independent backups of business data unless a care plan covering backups is active.
10. Termination
- The Client may cancel a project at any time in writing. On cancellation, the Client remains liable for all work completed to date, the advance is retained, and any milestone in progress is billed proportionally.
- We may terminate for non-payment (clause 2), for abusive conduct toward our team, or where the project is used for unlawful purposes — with no refund of amounts already paid.
11. Governing law
These Terms are governed by the laws of Pakistan. Any dispute is subject to the exclusive jurisdiction of the courts of Lahore.
